Missouri Age Discrimination Law

Under the Missouri Human Rights Act individuals who are between the ages of 40 and 70 years are protected against employment discrimination based on age. Both employees and applicants are protected under the Missouri Human Rights Act, which makes it unlawful to discriminate in any term of employment including hiring, firing, promotion, termination, compensation, job assignments and training.

Forms of Age Discrimination

  • A company fires or lays off the oldest workers first because those employees often make the highest salary having been with the company the longest
  • A manager passes over an older employee for promotion and instead hires someone younger for the position
  • An employer prevents an older employee from taking training courses or otherwise investing in improving the employee's career

Age discrimination can take many different forms. Whether you have been fired, passed over for a promotion, or you have been treated differently than other employees because of your age, you may have a legal claim against the employer.

Federal Age Discrimination Law

The Age Discrimination in Employment Act of 1967 (ADEA) is a Federal law which protects employees who are over 40 years old from employment discrimination based on age. The ADEA applies to employers with 20 or more employees as well as to labor organizations and employment agencies. The Act makes it unlawful for an employer to "fail or refuse to hire or discharge any individual or otherwise discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual's age." As with Missouri law, the ADEA applies to hiring, discharge, promotion, compensation, and other aspects of employment relations.
