What Is The Difference Between A 'Wrongful' Termination And A Legal Termination?

It can often be difficult to determine the actual reason behind an employer's decision to terminate an employee. As the term indicates, an employer must illegally discharge an employee for the termination to constitute legal action. No matter how unfair an employer's decision to terminate or fire an employee, there are instances where the employee has been treated improperly by societal standards but there is simply no legal recourse.

Employment At-Will Doctrine

In Missouri, employment law is governed by a legal theory known as the at-will employment doctrine. Essentially, the employment at-will doctrine means that the legal system considers employment to be voluntary and indefinite for both the employee and the employer. An employer has the right to discharge an employee at any time, for any reason, or for no reason at all.

Wrongful Termination Based On Discrimination

If you have been wrongfully terminated because of your age, race, sex, disability, religion or national origin you will first need to file a charge with the Missouri Human Rights Commission and/or the Equal Employment Opportunity Commission. Once you file a charge you will receive a 'right to sue' letter which permits you to file a complaint against your former employer based on Missouri and Federal employment laws.
